The Firm has advised financial investors, lenders and leasing companies in relation to aircraft financing transactions; has assisted in structuring the financing and the payment mechanisms. In this regard the Firm has been involved in negotiating documentation for commercial short and long term debt towards the acquisition cost of the aircraft, finance and operating lease agreements, finance lease agreements, security documents and related documents. Members of the Firm also have the expertise to provide advisory services to banks, export credit agencies, financial institutions and leasing companies on regulatory issues, structuring and tax related issues for financing and leasing of aircraft into India and to provide advice on financing and leasing of engines into India, aircraft heavy and general maintenance contracts, MRO and related works contracts, and GTAs with service providers.
The Firm has extensively advised and assisted lenders and leasing companies on strategic issues in connection with repossession of aircraft and aircraft engines (both hostile and consensual). We have advised clients on issues relating to insolvency law, restructuring of leasing arrangements, drafting of documents for repossession and making regulatory filings. Members of the Firm have also interacted with regulatory authorities regarding matters of commercial financing and leasing of aircraft into India, and provided general advisory services on insurance, creation of charges, registration and stamp duty related issues.
